These terms are an agreement between you and [OPERATOR FULL LEGAL NAME] — [OPERATOR FULL LEGAL NAME], a New Zealand sole trader trading as Mendly — the operator of Mendly. By creating an account or using Mendly you accept these terms and the Privacy Policy. If you do not accept them, please do not use Mendly.
These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction.
Mendly is a self-management and information tool that helps you keep track of your recovery: movements, pain scores, medication, appointments, contacts and messages with a care-team member you have approved.
Mendly does not provide medical advice, diagnosis or treatment, is not a medical device, is not clinically validated, and is not an emergency service or a monitored channel. It does not replace advice from your doctor, physiotherapist, pharmacist or other qualified health practitioner. Read the Medical Disclaimer before relying on anything in the app.
You own the information you put into Mendly. You give us permission to store and process it so we can provide the service, as described in the Privacy Policy.
Sharing with a care-team member is off until you approve their request and switch on the specific categories you want them to see. Only give your share code to people you trust. You can change or withdraw sharing at any time.
You agree not to:
We aim to keep Mendly available and reliable but cannot guarantee uninterrupted access. Features may change, and we may suspend or withdraw parts of the service, including for maintenance. Keep your own copy of anything you cannot afford to lose — you can download your data at any time from Account → Privacy & data.
Mendly is provided “as is”. To the extent permitted by law, we exclude all warranties and are not liable for loss arising from decisions made in reliance on information in Mendly, from delayed or unread messages, or from any interruption to the service. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply. If you use Mendly for business purposes, those Acts do not apply.
Where liability cannot be excluded, our total liability is limited to [LIABILITY CAP — to be confirmed by the operator].
You can stop using Mendly at any time and request deletion of your account from Account → Privacy & data. We may suspend or close an account that breaches these terms or puts other people's information at risk.
We may update these terms. The current version and effective date are shown at the top of this page. If a change materially affects you, we will ask you to accept the new version before you keep using Mendly.
